Cloud Telephony & VoIP Solutions

This Fair Usage Policy (“Policy”) applies to all VoIP and Cloud Telephony Services supplied by technologE Ltd under Schedule 3 – Hosted Telecoms / VoIP / Teams Voice and the Master Terms and Conditions.
It forms part of the Agreement and should be read alongside the Price List / Rate Card.
This Policy applies equally to all hosted and cloud-based telephony platforms supplied by technologE Ltd, including but not limited to Microsoft Teams Voice, Cisco Webex, 3CX Hosted Telephony, and any equivalent or successor systems (“Hosted Telephony Services”).
The following sections outline the fair usage thresholds, prohibited 
uses, responsibilities, and enforcement measures applicable to all 
Hosted Telephony Services.


1. General Principles
1.1 VoIP and Cloud Telephony Services are supplied for the legitimate business use of the Customer and its End Users only.
1.2 Use must remain fair, reasonable and proportionate compared with typical business usage on the relevant Service.
1.3 technologE reserves the right to monitor usage and take reasonable steps where usage breaches this Policy, Applicable Law, Ofcom rules, or impacts service quality.


2. Fair Usage
2.1 Inclusive Call Allowances “Unlimited UK Calls” apply only to standard UK geographic numbers (01, 02, 03) and UK mobile numbers (07, excluding 070, 076, 09, or premium/international ranges).
2.2 Thresholds
Inclusive allowances are subject to a fair usage threshold of 3,000 minutes per Extension per month, pooled across all Extensions on the same Customer account.
2.3 Excessive or Unreasonable Use Usage may be deemed excessive or unreasonable if it:
• exceeds five (5) times the average business usage across technologE’s customer base;
• is primarily for call resale, continuous call forwarding, contact centre traffic, automated dialling, campaigns, or “always on” connections; or

• shows abnormal call patterns inconsistent with ordinary business use.
2.4 International and Premium Calls
International, premium rate, directory enquiry, and non-geographic calls are excluded from inclusive allowances unless expressly stated in the Order Form or Rate Card. These calls will be charged at technologE’s prevailing Rate Card.

 

3. Prohibited Use
Customers and End Users must not:
• use Services for unlawful, fraudulent, harmful or criminal activity;
• initiate nuisance calls, phishing, spamming, or denial-ofservice activity;
• employ auto-diallers or platforms generating automated/bulk traffic;
• misuse call forwarding, voicemail or redirection features to avoid Charges or facilitate fraud;
• resell, share, or otherwise commercially exploit Services without technologE’s prior written consent.


4. Customer Responsibilities
The Customer shall:
• ensure End Users are made aware of and comply with this Policy;
• configure call features securely and implement appropriate safeguards;
• remain responsible for all use of the Services, whether authorised or unauthorised;
• remain liable for all Charges arising from unauthorised or fraudulent use until technologE has been notified and has had reasonable time to suspend the affected Service;
• promptly notify technologE of any suspected misuse, fraud, or Policy breach.


5. Enforcement
5.1 technologE may take proportionate action if this Policy is breached, including:
(a) issuing warnings;
(b) applying additional Charges at the prevailing Rate Card;
(c) requiring migration to a more appropriate tariff or bundle;
(d) restricting or suspending Services;
(e) terminating the affected Service(s) in accordance with the Agreement.
5.2 technologE’s determination of whether usage is excessive, unreasonable, or in breach of this Policy shall be final.
5.3 Charges will continue to accrue during any suspension.


6. Related Documents and Third-Party Policies
Where technologE Ltd provides Hosted Telephony Services based on the 3CX platform, the 3CX Fair Usage Policy shall also apply and is incorporated herein by reference.

technologE Ltd reserves the right to monitor, restrict, or suspend any 3CX-based instance or related service where usage exceeds 3CX’s published limits (including extension caps, concurrent-call limits, or AI feature usage quotas) or otherwise breaches 3CX’s terms.


7. Updates
This Policy may be updated from time to time. The latest version will always be published with the Price List/Rate Card.
