Fair Usage Policy – Business Mobile Solutions (Mobile Services)
This Fair Usage Policy (“Policy”) applies to all Mobile Services supplied by technologE Ltd under Schedule 1 – Business Mobile Solutions and the Master Terms and Conditions. It forms part of the Agreement and should be read alongside the Price List/Rate Card.
1. General Principles
1.1 Mobile Services are supplied for the legitimate business use of the Customer and its End Users only.
1.2 Use must remain fair, reasonable and proportionate compared with typical business usage on the relevant Tariff.
1.3 technologE reserves the right to monitor usage and take reasonable steps where usage breaches this Policy, Ofcom rules in accordance with Ofcom GC C3 and GC C8 or impacts network integrity.
2. Voice Calls
“Unlimited” UK calls are intended for standard business person-to-person communication. technologE reserves the right to investigate usage that materially exceeds typical business patterns (normally above 3,000 minutes per Connection per billing month or equivalent sustained over two months) and may apply restrictions in line with the underlying network provider’s policy.
Maximum call duration is two (2) hours per call (redial permitted).
Inclusive allowances cover standard UK landline (01, 02, 03) and mobile (07) numbers only. Premium, non-geographic, and international calls are excluded.
Use for call centres, auto-diallers, PBX routing, gateways, resale, broadcast or artificial traffic is prohibited.
3. Text Messages (SMS)
“Unlimited” or inclusive SMS allowances are subject to 3,000 SMS per Connection per billing month.
SMS must be used for standard business person-to-person communication only. Bulk, automated, spam, or marketing messages are not permitted.
4. Data Usage (UK)
“Unlimited” or inclusive UK data allowances are subject to a fair usage threshold of 650 GB in any rolling six-month period (or equivalent to around 100 GB per month). technologE may apply traffic management measures if this threshold is regularly exceeded, consistent with the underlying wholesale network provider’s policy.
After this threshold, technologE may apply traffic management, speed restrictions, or out-of-bundle charges as per the Tariff.
Tethering and hotspotting are permitted for normal business activity but may be restricted if causing network congestion or excessive usage.
5. Roaming Usage (EU/EEA)
EU/EEA roaming is subject to a fair usage limit set by the relevant Network Operator (typically 25 GB per Connection per billing month, with network-specific caps set out in section 8) unless a higher allowance is stated on the Order Form. Permanent or near-permanent roaming outside the UK (typically where more than 50% of usage occurs abroad over four consecutive months) is not permitted. Surcharges may be applied in accordance with Ofcom GC C3 and the underlying network’s roaming fair use policy.
Roaming use must be periodic. Permanent or near-permanent roaming outside the UK is not permitted.
technologE may impose surcharges, suspend roaming, or terminate the affected Connection if:
more than 50% of usage occurs outside the UK over a continuous four-month period; or
the Connection shows long inactivity in the UK combined with significant roaming usage.
Notifications will be provided before any surcharge or restriction is applied, in line with Ofcom GC C3.
6. Prohibited Use
Customers and End Users must not:
Resell, share, or commercially exploit SIMs or Services.
Use SIMs in equipment for M2M or IoT purposes unless expressly agreed.
Engage in spam, fraud, nuisance, or unlawful activity.
Cause network congestion or use Services in a way that harms other users.
7. Enforcement
7.1 technologE may take proportionate action if this Policy is breached, including:
(a) issuing warnings;
(b) charging out-of-bundle rates;
(c) applying speed restrictions or traffic management;
(d) suspending or restricting Services;
(e) terminating the affected Connection(s) in accordance with the Agreement.
(f) applying a Cease Charge of £50 per Connection where termination is due to breach of this Fair Usage Policy or the underlying wholesale provider’s terms.
7.2 This Policy may be updated from time to time. The latest version will always be published with the Price List/Rate Card.
8. Network-Specific Fair Usage Provisions
8.1 Scope. This section sets out Network Operator specific fair usage provisions that apply in addition to sections 1–7. Where a Network Operator’s own policy imposes a stricter limit than set out in sections 1–7, the stricter limit applies.
EE Network
8.2 Unlimited allowances. EE “Unlimited” tariffs are truly unlimited where usage is appropriate to the subscription type. Inappropriate usage includes: usage outside normal commercial practice; automated or gateway/AIT usage; fraudulent, abusive, illegal or nuisance usage; regular tethering to create local hotspots for other devices; and data roaming outside the UK exceeding 25 GB in a billing month.
8.3 Roaming. EE inclusive roaming is capped at 25 GB per Connection per billing month on Unlimited tariffs. Beyond this cap, further data within that billing period is charged at EE’s out-of-bundle roaming rates. Roaming activity is measured over a rolling four-month period.
O2 Network
8.4 Unlimited allowances. O2 “Unlimited” tariffs are truly unlimited where usage is appropriate to the subscription type. Inappropriate usage includes: usage outside normal commercial practice; automated or gateway/AIT usage; fraudulent, abusive, illegal or nuisance usage; regular tethering to 12 or more devices or using 650 GB of data twice within a rolling six-month period; data roaming outside the UK exceeding 25 GB in a billing month; and UK to EU international minute usage above 3,000 minutes in a billing month.
8.5 Roaming. O2 customers can use their domestic bundle as they would at home when roaming in a Roam Like at Home (RLAH) destination, subject to a 25 GB data cap per Connection per billing month. Beyond this cap, a charge of £2.00 per GB applies. Roaming activity is measured over a rolling four-month period.
Vodafone Network
8.6 Unlimited allowances. Vodafone “Unlimited” tariffs are truly unlimited where usage is appropriate to the subscription type. Inappropriate usage includes: usage outside normal commercial practice; automated or gateway/AIT usage; fraudulent, abusive, illegal or nuisance usage; regular tethering to create local hotspots for other devices; and data roaming outside the UK exceeding 25 GB in a billing month.
8.7 Roaming. Vodafone Unlimited plans are capped at 25 GB per billing month in European Travel Select, Travel Free and Travel Plus destinations. Beyond this cap, a charge of £2.13 per 1 GB (ex VAT) applies until the monthly allowance renews. Roaming activity is measured over a rolling four-month period.
Applicable to All Networks
8.8 Gateways and Artificially Inflated Traffic (AIT). SIMs must not be used in any equipment enabling the routing of calls or data (including SMS or MMS) from fixed apparatus or standard devices to mobile equipment, or enabling bulk SMS, voice or data services. technologE reserves the right to suspend Services without notice where such use is suspected. During suspension, liability for access charges or calls remains with the Customer.
8.9 Voice tariffs and device use. All tariffs under this Policy are designed for use with smartphones or similar voice-enabled personal devices. Use in data-only, machine-to-machine (M2M), Internet of Things (IoT), router or fixed wireless access scenarios is not permitted unless expressly agreed in writing. Where data-only or M2M connectivity is required, technologE can supply an alternative solution upon request.
8.10 Ofcom compliance. Nothing in this section limits any Customer rights under Ofcom’s General Conditions, including GC C1 (contract transparency), GC C3 (roaming and Spend Caps), and GC C7 (switching and portability). technologE will provide notifications and remedies as required by those rules.
